           DG(W), CPWD is pleased to decide that earth work appearing at Sl.No. 17.3 (ii) of CPWD Works Manual, 2003 be deleted from the list of specialised items/ jobs/works.

          In exercise of powers vested with him, DG(W), CPWD is pleased to declare that “Anti Termite Chemical Treatment” shall be treated as specialised work/item in addition to works/items already listed under paragraph 17.3.(vi) of CPWD Works Manual 2003 and other office memos issued from time to time.

          It is to clarify here that this order of declaring “Anti Termite Chemical treatment” does not supercede order of banning of Pre-construction Chemical Treatment as Anti Termite measures issued vide O.M. No S.E(S&S)EEI/Banning Pre-Const.ATI/1999-2000/255 dt. 10.9.99.

              Attention is invited to the following circulars of this Directorate.

     Decision to invite tenders for works costing upto 2 crore from CPWD registered contractors  only was conveyed vide O.M. No. DGW/MAN/44 dt. 8.2.2000.   This decision, however, was being deferred from time to time by various orders as mentioned above, the last being  dated 8.1.2003.

    It has been decided by DG(W) , CPWD that, for works costing upto Rs. 2 crores, there will be no further deferment of the order dated 8.2.2000.

   It has also been decided that Additional Director Generals of different regions may relax the provision of inviting tenders only from CPWD registered contractors  for works costing upto Rs. 2.0 crores for specific Divisions/Circles/Zones for the period they  consider it necessary, in the interest of works.

Subject: Augmentation of electric power supply to the residences of

               VIPs - Delegation of powers.

          The Management Committee for CPWD in its 16th meeting ( held on 15.10.2003, 21.10.2003 and 23.10.2003 ) decided that delegation of financial powers to DG(W),CPWD for augmentation of electric power supply to the residences of VIPs would be as per maximum electrical load sanctioned.  Accordingly, the Committee has removed the financial limit of Rs.1.00 lakh in respect of financial power of DG(W),CPWD and approved full financial power to DG(W) for augmentation of electrical power supply to residences of VIPs upto sanctioned maximum load.  Further the estimate for such augmentation should include cost of changing of cables also wherever necessary.

          The provisions of DGW/MAN/31 dated 22.7.99 accordingly, stand modified.

Subject:  Delegation of powers to ADGs for declaration of specialized

                items.

          It was felt by the drafting Committee for CPWD works Manual that only a limited number of items should be included in the list of specialized items/jobs/works.  Accordingly the list of specialized items/jobs/works was cut short substantially in Works Manual 2003.

          Number of requests were being received by the Directorate for declaration of more items as specialized items/jobs/works.  The issue was discussed in the Technical Board meeting held on 7.1.04 so that a policy may be framed for declaration of specialized items/jobs/works.

          It was decided by the Technical Board that Addl. Director Generals of CPWD(ADG(TD) for works in and around Delhi, as decided by DG(W),CPWD )  be delegated power to declare an item/job/work as specialized item/job/work. While declaring an item/job/work as specialized, it should be taken care that the item/job/work which cannot be got done directly from general registered contractors and that it requires special T&P and specialized skill.  In order to maintain uniformity, it was decided that ADGs will circulate such office memorandum among other ADGs with information to the Directorate and also publish the same on internet.  ADG(TD) will be nodal officer for a data bank of all such cases where ADGs of regions declare specialized item of work.

          ADGs will also approve list of specialized agencies every year in the month of May for their regions.  Provision of para 17.2 of Works Manual 2003 that for recorded reasons the Chief Engineer is competent to permit any particular person or firm, who are not borne on the approved list of CPWD or any other Government Department, to tender for specialized works, will remain applicable.

Subject:  Purchase through DGS&D

1.      Attention is invited to para 37.10 of Works Manual 2003 wherein more materials have been added in the list of excepted items to be purchased through agencies of DGS&D.  These are cement, steel, GI and CI pipes and fittings, water supply fittings, sanitary wares and fittings, fans, electrical fittings, fixtures and wires.

2.      Difficulties arising out of this addition in Works Manual 2003 were discussed in the meeting of Technical Board dated 7.1.2004.  It was decided to delegate powers to Chief Engineers of CPWD for relaxing the provision of para 37.10 for recorded reasons in emergent cases for the procurement of the newly added articles and allow procurement of these newly added articles through agencies of DGS&D in the interest of work.

          These  relaxation should not be given as a routine matter.

3.      Para 37.13 of Works Manual 2003 which provides that irrespective of their monetary value, indents for excepted articles mentioned in para 37.10 are not to be placed on the DGS&D is also modified to the effect as mentioned in para 2 above for newly added articles in the list of excepted articles.

Sub :  Departmental Procurement  of Steel (TMT/CTD bars).

          Attention is invited to O.M. No. DGW/MAN/18 dt. 30.6.98 and provisions of para 37.10, 37.13, 37.28 to 37.30 and 38.3 of CPWD Works Manual 2003. 

Difficulties in procurement of steel was considered in meeting of the Technical Board held on 16.3.2004  and following procedures for departmental procurement of steel  was decided.

1.                 EEs may procure steel directly from main producers without call of quotations or tenders for supply of steel upto Rs.10 lakh only once against each technically sanctioned work.  In case steel is not available from main producers, procedure as given below for requirement of steel beyond Rs. 10 lakh shall be followed by E.Es.

For requirement of steel beyond Rs. 10 lakh, against a particular technically sanctioned work, the authority in whose powers amount of total quantity of steel to be procured against that work falls, shall be competent to procure the steel.

2.                 For requirement of steel beyond Rs.10 lakh, tenders/quotations should be called from main producers and secondary producers, with wide publicity in the press and website as per the  procedure given below.  This is in partial modification to O.M. No. DGW/MAN/18 dt  30.6.98.

2.1         In the first instance tenders/quotations should be invited from the main producers only.

2.2.1      In case there is no response from the main producers, for supply of steel as per requirements of quantity or time period stipulated by the department, then the tenders/quotations shall be called from the secondary producers as well, having valid BIS License.

2.2.2      While calling tenders/quotations from main producers or the secondary producers, an Earnest   money @ 2% of the estimated cost put to tender, subject to maximum limit of Rs.1 lakh   should be stipulated.  Performance guarantee     @ 5% of the estimated cost put to tender, may also be stipulated. However, depending upon urgency of the requirement, response from the              main/secondary producer and the local conditions prevailing, the authority competent to accept the  tenders/quotations shall have discretion to vary or waive the quantum of EM or PG  or both  as the case may be.

2.2.3      If the rates quoted by secondary producer are the lowest,  purchase preference shall be  given to  Public Sector Enterprises as per para 14.6.1 of Works Manual 2003. A suitable clause shall be inserted in the open advertisement for this purchase preference.

2.3    .Powers to accept Supply order of steel based on tender or quotations shall be the same       as  the  powers to accept tenders of work. The amount of Supply order for  steel based on quotations  shall not be included in the annual limit of powers for award of work without call of tenders.

Subject :      Review of the system of Pre Qualification of contractors and procedure for issuing tender document to contractors.

          Recommendation of K.K. Verma committee on “ Review of the system of pre-qualification of contractors” was discussed in the Technical Board meeting held on 16.3.2004 and following decisions were taken :-

1.                 The existing system of Pre qualification of contractors, prior to call of financial bid, is kept in abeyance for a period of two years.

2.                 System of Post – qualification ( i.e. submitting PQ document alongwith financial bid) instead of prior Pre-Qualification of contractors shall be followed for works estimated to cost more than Rs. 10 crore.

3.                 There shall be no Post –Qualification for works costing upto Rs. 10 crore.  However in exceptional cases, ADGs can go for Post –qualification for works costing between Rs. 5 crore to Rs.10 crore, with recorded reasons, on the grounds given at Sl. (i) to (v) of para 16.5.1(b) of  Works Manual 2003.

4.                 Following procedures shall be adopted for call of tenders based on Post-Qualification system :-

Tenders shall be invited in two envelope system.  One envelope shall contain Earnest Money alongwith Technical bid and documents in support of eligibility.  The other envelope shall have financial bid.  There shall be a pre-bid conference for intending contractors in which any doubts of contractors shall be clarified besides discussions on any additional condition proposed by the tenderers.  If found necessary, an addendum/corrigendum to tender document would be issued and thereafter no further query/condition shall be entertained.  There would be no bar to hold the pre-bid conference more than once especially in more complex types of works.  Envelope containing Earnest Money and technical bid shall be opened first.  Technical bids having valid Earnest Money deposits shall be evaluated and qualified by the competent authority.  Financial bid of qualified contractors only shall be opened at notified time, date and place in presence of qualified contractors or their representatives. There shall be a gap between opening of technical and financial bid as decided by NIT approving authority. The validity of tenders shall be reckoned from the date of opening of financial bid.

5.                 Standard PQ document with modifications in respect of experience for similar works as mentioned below shall be used for post qualification.  Specific requirements of men and machinery in the work can be stipulated in the PQ document.  Other provisions of the DGW/MAN/65 dated 4.4.2001 and para 16.5.1 to 16.5.7 of Works Manual 2003 shall continue to apply.

6.                 Procedure for issue of tender documents to Contractors.

In partial modification of provisions of para 17.10 of Works Manual 2003, criteria for issue  of tenders in CPWD in respect of eligible CPWD as well as non CPWD contractors will be as  under :-

a.      For works costing upto Rs. 2 crore, tenders shall be issued only to CPWD contractors as laid down in para 17.10 (a) of Works Manual 2003.

b.     For works costing over Rs. 2 crore and upto Rs. 10 crore, tender shall be issued to eligible registered contractors of CPWD and to those non-CPWD  registered contractors of MES, P&T, Railways, concerned State PWDs and CPWD Class II contractor  who have satisfactorily executed similar works as laid down in para 17.10(b) of Works Manual 2003. However for works costing Rs. 5 to 10 crores, ADGs can make exemption as stated in para 3 above.

c.     For works costing more than Rs. 10 Crore, contractors with or without any registration may be allowed to tender provided they submit proof of having satisfactorily completed,  during the last 7 years, two similar works each costing not less than 60% of the estimated cost  or one similar work costing not less than the estimated cost of the work put to tender in partial modification of para 17.10 (c).  Para  4  above will be applicable here.

          In light of powers delegated as per para 37.13 of Works Manual 2003 for purchase of materials given in the list of excepted articles, powers of CPWD officers for local purchase were deleted in Works Manual 2003.  These items are also not to be procured through DGS&D.

          As a result of discussions in the meeting of Technical Board held on 7.1.2004, regarding difficulties in procurement of electrical items and other materials (except steel), following decisions have been taken.

1.        Materials given in the list of excepted items can be procured through DGS&D at the discretion of C.E. with recorded reasons.  O.M. No. DGW/MAN/108 dated 8.4.2004 in this regard has already been issued.

          The Management Committee for CPWD in its 16th meeting ( held on 15.10.2003, 21.10.2003 and 23.10.2003 ) decided that delegation of financial powers to DG(W),CPWD for augmentation of electric power supply to the residences of VIPs would be as per maximum electrical load sanctioned.  Accordingly, the Committee has removed the financial limit of Rs.1.00 lakh in respect of financial power of DG(W),CPWD and approved full financial power to DG(W) for augmentation of electrical power supply to residences of VIPs upto sanctioned maximum load.  Further the estimate for such augmentation should include cost of changing of cables also wherever necessary.

          The provisions of DGW/MAN/31 dated 22.7.99 accordingly, stand modified.

Subject:  Delegation of powers to ADGs for declaration of specialized

                items.

          It was felt by the drafting Committee for CPWD works Manual that only a limited number of items should be included in the list of specialized items/jobs/works.  Accordingly the list of specialized items/jobs/works was cut short substantially in Works Manual 2003.

          Number of requests were being received by the Directorate for declaration of more items as specialized items/jobs/works.  The issue was discussed in the Technical Board meeting held on 7.1.04 so that a policy may be framed for declaration of specialized items/jobs/works.

          It was decided by the Technical Board that Addl. Director Generals of CPWD(ADG(TD) for works in and around Delhi, as decided by DG(W),CPWD )  be delegated power to declare an item/job/work as specialized item/job/work. While declaring an item/job/work as specialized, it should be taken care that the item/job/work which cannot be got done directly from general registered contractors and that it requires special T&P and specialized skill.  In order to maintain uniformity, it was decided that ADGs will circulate such office memorandum among other ADGs with information to the Directorate and also publish the same on internet.  ADG(TD) will be nodal officer for a data bank of all such cases where ADGs of regions declare specialized item of work.

          ADGs will also approve list of specialized agencies every year in the month of May for their regions.  Provision of para 17.2 of Works Manual 2003 that for recorded reasons the Chief Engineer is competent to permit any particular person or firm, who are not borne on the approved list of CPWD or any other Government Department, to tender for specialized works, will remain applicable.

2.      Difficulties arising out of this addition in Works Manual 2003 were discussed in the meeting of Technical Board dated 7.1.2004.  It was decided to delegate powers to Chief Engineers of CPWD for relaxing the provision of para 37.10 for recorded reasons in emergent cases for the procurement of the newly added articles and allow procurement of these newly added articles through agencies of DGS&D in the interest of work.

          These  relaxation should not be given as a routine matter.

3.      Para 37.13 of Works Manual 2003 which provides that irrespective of their monetary value, indents for excepted articles mentioned in para 37.10 are not to be placed on the DGS&D is also modified to the effect as mentioned in para 2 above for newly added articles in the list of excepted articles.

1.                 EEs may procure steel directly from main producers without call of quotations or tenders for supply of steel upto Rs.10 lakh only once against each technically sanctioned work.  In case steel is not available from main producers, procedure as given below for requirement of steel beyond Rs. 10 lakh shall be followed by E.Es.

For requirement of steel beyond Rs. 10 lakh, against a particular technically sanctioned work, the authority in whose powers amount of total quantity of steel to be procured against that work falls, shall be competent to procure the steel.

2.                 For requirement of steel beyond Rs.10 lakh, tenders/quotations should be called from main producers and secondary producers, with wide publicity in the press and website as per the  procedure given below.  This is in partial modification to O.M. No. DGW/MAN/18 dt  30.6.98.

2.1         In the first instance tenders/quotations should be invited from the main producers only.

2.2.1      In case there is no response from the main producers, for supply of steel as per requirements of quantity or time period stipulated by the department, then the tenders/quotations shall be called from the secondary producers as well, having valid BIS License.

2.2.2      While calling tenders/quotations from main producers or the secondary producers, an Earnest   money @ 2% of the estimated cost put to tender, subject to maximum limit of Rs.1 lakh   should be stipulated.  Performance guarantee     @ 5% of the estimated cost put to tender, may also be stipulated. However, depending upon urgency of the requirement, response from the              main/secondary producer and the local conditions prevailing, the authority competent to accept the  tenders/quotations shall have discretion to vary or waive the quantum of EM or PG  or both  as the case may be.

2.2.3      If the rates quoted by secondary producer are the lowest,  purchase preference shall be  given to  Public Sector Enterprises as per para 14.6.1 of Works Manual 2003. A suitable clause shall be inserted in the open advertisement for this purchase preference.

2.3    .Powers to accept Supply order of steel based on tender or quotations shall be the same       as  the  powers to accept tenders of work. The amount of Supply order for  steel based on quotations  shall not be included in the annual limit of powers for award of work without call of tenders.

Subject :      Review of the system of Pre Qualification of contractors and procedure for issuing tender document to contractors.

          Recommendation of K.K. Verma committee on “ Review of the system of pre-qualification of contractors” was discussed in the Technical Board meeting held on 16.3.2004 and following decisions were taken :-

1.                 The existing system of Pre qualification of contractors, prior to call of financial bid, is kept in abeyance for a period of two years.

2.                 System of Post – qualification ( i.e. submitting PQ document alongwith financial bid) instead of prior Pre-Qualification of contractors shall be followed for works estimated to cost more than Rs. 10 crore.

3.                 There shall be no Post –Qualification for works costing upto Rs. 10 crore.  However in exceptional cases, ADGs can go for Post –qualification for works costing between Rs. 5 crore to Rs.10 crore, with recorded reasons, on the grounds given at Sl. (i) to (v) of para 16.5.1(b) of  Works Manual 2003.

4.                 Following procedures shall be adopted for call of tenders based on Post-Qualification system :-

Tenders shall be invited in two envelope system.  One envelope shall contain Earnest Money alongwith Technical bid and documents in support of eligibility.  The other envelope shall have financial bid.  There shall be a pre-bid conference for intending contractors in which any doubts of contractors shall be clarified besides discussions on any additional condition proposed by the tenderers.  If found necessary, an addendum/corrigendum to tender document would be issued and thereafter no further query/condition shall be entertained.  There would be no bar to hold the pre-bid conference more than once especially in more complex types of works.  Envelope containing Earnest Money and technical bid shall be opened first.  Technical bids having valid Earnest Money deposits shall be evaluated and qualified by the competent authority.  Financial bid of qualified contractors only shall be opened at notified time, date and place in presence of qualified contractors or their representatives. There shall be a gap between opening of technical and financial bid as decided by NIT approving authority. The validity of tenders shall be reckoned from the date of opening of financial bid.

5.                 Standard PQ document with modifications in respect of experience for similar works as mentioned below shall be used for post qualification.  Specific requirements of men and machinery in the work can be stipulated in the PQ document.  Other provisions of the DGW/MAN/65 dated 4.4.2001 and para 16.5.1 to 16.5.7 of Works Manual 2003 shall continue to apply.

6.                 Procedure for issue of tender documents to Contractors.

In partial modification of provisions of para 17.10 of Works Manual 2003, criteria for issue  of tenders in CPWD in respect of eligible CPWD as well as non CPWD contractors will be as  under :-

a.      For works costing upto Rs. 2 crore, tenders shall be issued only to CPWD contractors as laid down in para 17.10 (a) of Works Manual 2003.

b.     For works costing over Rs. 2 crore and upto Rs. 10 crore, tender shall be issued to eligible registered contractors of CPWD and to those non-CPWD  registered contractors of MES, P&T, Railways, concerned State PWDs and CPWD Class II contractor  who have satisfactorily executed similar works as laid down in para 17.10(b) of Works Manual 2003. However for works costing Rs. 5 to 10 crores, ADGs can make exemption as stated in para 3 above.

c.     For works costing more than Rs. 10 Crore, contractors with or without any registration may be allowed to tender provided they submit proof of having satisfactorily completed,  during the last 7 years, two similar works each costing not less than 60% of the estimated cost  or one similar work costing not less than the estimated cost of the work put to tender in partial modification of para 17.10 (c).  Para  4  above will be applicable here.

          In light of powers delegated as per para 37.13 of Works Manual 2003 for purchase of materials given in the list of excepted articles, powers of CPWD officers for local purchase were deleted in Works Manual 2003.  These items are also not to be procured through DGS&D.

          As a result of discussions in the meeting of Technical Board held on 7.1.2004, regarding difficulties in procurement of electrical items and other materials (except steel), following decisions have been taken.

1.        Materials given in the list of excepted items can be procured through DGS&D at the discretion of C.E. with recorded reasons.  O.M. No. DGW/MAN/108 dated 8.4.2004 in this regard has already been issued.

2.        Supplies can be taken on tender/quotations with wide publicity with stipulation of Earnest Money at the rate of 2% of the Estimated cost subject to a maximum of Rs. 1.0 lakh and stipulation of 5%  Performance Guarantee.  However, amount of earnest money and performance guarantee can be varied/waived with recorded reasons by the authority competent to accept the tender/quotation depending upon urgency of the requirement, expected response and operating market environment.

3.        In such cases, powers of CPWD Officers for acceptance of tenders for supplies will be same as for acceptance of tenders for works.  Amount of such supply order shall not count towards the ceiling of award of work without call of tenders.                           Sd/- 30/4/4

2.22 After receipt of administrative approval and expenditure sanction, detailed estimates are required to be prepared for technical sanction.  As its name indicates, it amounts to no more than a guarantee that the proposals are structurally sound and that the estimates are accurately calculated and based on adequate data.
